During the last year our little boutique tax and fraud practice has grown from 2 lawyers to 9 with offices in 4 states and another in San Francisco opening soon. While on a plane yesterday I was asked why we are growing so fast. After reading today’s newspaper, I realized that our success is somewhat tied to the failings of society.
Our tax practice grows because of the rise of big government. Our tax system has become so complex that tax lawyers are often needed to make sense of tens of thousands of pages of government regulations. Our fraud pracice, however, is directly tied to the what is happening in society.
I call it the increasing lack of personal responsibility.
Two examples jumped out at me this morning as I read the local paper. In a front page story, a couple filed suit against a local school district. Their disabled 7 year old daughter died on a school bus. According to the complaint, both the driver and a bus aide were aware that the child was not breathing. It took 11 agonizing minutes for someone to dial 911 and seek help.
While the child suffered and tried desperately, the aide and bus driver apparently used a cell phone to call a supervisor and await instructions. The child died while two adults debated what to do about the dying child.
In another story, a lawyer who represents the disabled went in to a local motor vehicle office and obtained a drivers license. This is AFTER he disclosed that he was legally blind and has only 5% of his vision. He even had to use his white tipped cane to find the counter and apply for his license.
A bureau of motor vehicle spokesperson had no comment.
Fraudsters continue to prey on society because more and more people we trust to protect us are asleep at the switch. No personal responsibility. Accounting malpractice claims? On the rise. Claims against lawyers? They are up too. And claims against lenders? Those have skyrocketed since 2007.
Our business is expanding because the number of people and businesses victimized by fraud continues to rise.
